Your agreement to these Terms
These Terms set out the rights and duties of everyone who visits or uses the Site. By using it you agree to be bound by them. If you disagree with any part, you must not use the Site.
You confirm that you are at least 18 years old. We do not allow anyone younger to use the Site.
Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use and disclose personal information and describes your privacy rights. Please read it as well.
Educational content, not advice
Everything on the Site is offered for educational and informational purposes. We are not your coach, therapist, physician, financial adviser or lawyer, and nothing here replaces advice from a qualified professional who knows your situation. We make no promise that following any idea on the Site will produce a particular result.
Our content and how you may use it
The text, graphics, logos, page layouts and other material on the Site belong to us or to our licensors and are protected by copyright, trademark and related laws. You may view the Site and print pages for your own personal, non-commercial use.
You may not copy, republish, sell, scrape or build derivative works from our content, reverse engineer any part of the Site, interfere with its operation or security, or use it for any unlawful purpose.
Links to other websites
The Site may link to websites or services that we neither own nor control. We have no say over their content, privacy practices or policies and accept no responsibility for them. You agree that we are not liable, directly or indirectly, for any loss or damage connected with your use of, or reliance on, anything available through those third parties. Read their terms and privacy notices before using them.
Ending your access
We may suspend or end your access to the Site at once, without advance notice or liability, for any reason, including a breach of these Terms. When that happens, your right to use the Site stops immediately.
Limits on our liability
Whatever damages you may suffer, the total liability of the Company and its suppliers under these Terms, and your only remedy, is limited to the amount you actually paid us through the Site, or 100 US dollars if you have not purchased anything.
To the fullest extent the law allows, neither the Company nor its suppliers will be liable for special, incidental, indirect or consequential damages of any kind, including lost profits, lost data or other information, business interruption, personal injury or loss of privacy, arising from or connected with the Site, with third-party software or hardware used alongside it, or with any provision of these Terms. This applies even if we were told that such damages were possible and even where a remedy does not achieve its essential purpose.
Certain states do not permit the exclusion of implied warranties or limits on incidental or consequential damages, so parts of this section may not apply to you. In those states our liability is limited to the greatest extent the law permits.
No warranties
The Site is provided as is and as available, with all faults and without warranty of any kind. To the fullest extent permitted by law, the Company disclaims, for itself and for its Affiliates, licensors and service providers, every warranty, whether express, implied, statutory or otherwise. That covers implied warranties about merchantable quality, suitability for a given purpose, ownership and the absence of infringement, as well as any warranty that might arise from a course of dealing, a course of performance or trade usage.
We do not promise that the Site will meet your needs, achieve any intended outcome, work with other software, systems or services, run without interruption, meet any standard of performance or reliability, or be free of errors, or that errors will be fixed. Nor do we warrant the accuracy, reliability or currency of information on the Site, or that the Site, its servers or emails sent on our behalf are free of viruses, scripts, worms, malware or other harmful components.
Some jurisdictions do not allow certain warranty exclusions or limits on the statutory rights of consumers, so some of the above may not apply to you. In that case the exclusions and limits apply to the greatest extent that is enforceable.
Governing law
The laws of the State of Colorado, without regard to its conflict-of-law rules, govern these Terms and your use of the Site. Other local, state, national or international laws may also apply to you.
Resolving disagreements
If you have a concern about the Site, please contact us first so that we can try to settle it informally.
Users in the European Union
If you are a consumer in the European Union, you keep the benefit of any mandatory protections under the law of the country where you live.
United States compliance
You confirm that you are not located in a country subject to a United States government embargo or designated by the United States as supporting terrorism, and that you do not appear on any list of restricted or prohibited parties maintained by the United States government.
Severability and waiver
If a court finds any provision of these Terms invalid or unenforceable, that provision will be adjusted to achieve its purpose as nearly as the law allows, and the remaining provisions will stay in force.
If we do not enforce a right or require you to perform an obligation, we are not giving up that right or obligation for the future, and overlooking one breach does not excuse a later one.
Language
If we have made these Terms available in another language, the English version controls in the event of a conflict.
Changes to these Terms
We may revise or replace these Terms at our discretion. For material changes we will try to give at least 30 days' notice before the new Terms take effect; what counts as material is our judgment. By continuing to use the Site after a change applies you accept the revised Terms. If you do not accept them, please stop using the Site.
